What happens to your tenancy when the landlord sells the property?

A sale does not mean an immediate move

A property may be sold with a tenant in occupation, or the owner may intend to sell with vacant possession. These are different situations. Ask the owner to explain the plan in writing: will your tenancy continue with a buyer, or will possession be sought?

For an ordinary English assured periodic tenancy, an agent's phone call about selling does not end the agreement. A valid ground, correct notice and, where necessary, court process apply. If the buyer keeps the tenant

Request official details of the new landlord, an address for notices, the management transfer date and rent instructions. Establish how the protected deposit has been transferred and who is responsible for repairs. Retain the original agreement, inventory, receipts and deposit scheme information.

Do not pay a new bank account solely on the strength of a message from an unfamiliar number. Verify the change through an established contact and written documents. Do not sign a replacement agreement with altered terms simply because an agent calls it a formality. Understand why it is needed and what changes first.

If the owner wants vacant possession

After the 1 May 2026 English reforms, a sale may use Ground 1A. This normally requires a section 8 notice identifying that ground and at least four months' notice; its expiry cannot fall within the first 12 months of a new tenancy. Some older assured tenancies cannot be ended on this ground. Check the tenancy type and dates against the current grounds guidance ↗.

A notice is not a bailiff's warrant. If the tenant remains, the landlord must follow the appropriate possession process; an English APT does not allow the owner to evict by changing locks personally. Viewings, agreements and support

Agree viewings separately: reasonable hours, advance arrangements and accompanied visitors. Selling does not remove your right to live in your home undisturbed. If voluntary early departure is proposed, record the date liabilities end, final rent, keys, deposit arrangements and any promised payment in writing. A verbal promise is insufficient.
