Match the leave to the situation

There is no single automatic paid “sick leave to care for a child” covering every operation. In England, Wales and Scotland, the options depend on urgency, the length of care, employee status and the employer's policy. Start with the operation and recovery dates, then identify the appropriate type of absence. Northern Ireland's separate local rules should be checked.

For an unexpected emergency involving a dependant, reasonable time off for dependants ↗ may apply. It is normally unpaid and allows you to deal with the immediate problem. A planned operation known about in advance does not automatically qualify.

Short leave for a long-term care need

Carer's leave ↗ is available to employees from the start of employment: up to one normal working week in a 12-month period to care for a dependant with a long-term care need. This includes an illness or injury expected to require care for more than three months, a disability under the Equality Act, or needs arising from old age.

It is unpaid and can be taken in days or half-days. A day or half-day normally requires at least three days' notice; a longer period requires at least twice its length. An operation alone does not guarantee eligibility if there is no qualifying long-term need. An employer cannot simply refuse the leave, although serious disruption can permit postponement under the prescribed process.

When you need several weeks

Consider unpaid parental leave ↗: up to 18 weeks per child before their 18th birthday, usually limited to four weeks per child per year for each parent. The current eligibility rules ↗ require employee status and parental responsibility; do not automatically apply the former one-year service requirement.

Leave is generally taken in whole weeks, with exceptions for a disabled child or agreement with the employer. Notice ↗ is normally 21 days. Parental leave used with a previous employer counts towards the overall allowance.

Make a workable arrangement

Send HR the dates, required period, proposed type of leave and any likely recovery contingency. Ask about compassionate leave, annual leave, temporary flexible arrangements or agreed unpaid leave. The company may offer more than the statutory minimum.

Confirm pay, how to request an extension, contact during absence and a date for reviewing the plan. If another parent will share care, coordinate the schedule beforehand. Your own sick leave is not appropriate solely because your child is ill: it requires your own incapacity for work.
