A family-route partner visa and dependant permission under a work or student route are different permissions. The general family visa guidance ↗ explains that if your partner is temporarily in the UK on a work or student visa, the relevant dependant route normally applies instead of a family visa.
For a family partner application ↗, first check the sponsor's eligible status and the relationship requirements. Marriage is not the only possible basis, but photographs together do not satisfy every category. Prepare a marriage or civil partnership certificate, or evidence meeting the applicable durable-relationship requirements, alongside evidence that previous marriages have ended.
Check whether you can apply inside the UK
Switching from an eligible existing visa may be possible before it expires. Visitors and most people with permission for six months or less normally need to leave and apply overseas. Specified exceptions, including qualifying fiancé permission, do not mean any tourist can remain after a wedding.
Decide where to apply and establish the deadline before booking travel. Consider children's status too: your new family application does not automatically replace their existing visas. Do not end a current employment arrangement merely because you intend to submit another form.
Meet the new financial and English requirements
Under the financial guidance ↗, a new partner application normally requires annual income of at least £29,000. Different provisions apply for certain sponsor benefits and some earlier family applications. An applicant's employment, overseas income and savings are accepted under specific categories and evidence requirements; simply adding every incoming payment together is insufficient.
Obtain a document checklist tailored to the chosen source, such as payslips, bank statements, an employer letter, or self-employment and savings records. Check the English requirement ↗ for this application. Budget for the application fee, IHS for the relevant period and translations. The fee for extending a work visa is not the applicable price.
Assess the settlement consequences
Under the ordinary five-year family partner route, time on a work or other visa does not count towards the five years as a partner. The partner guidance ↗ expressly states this. Long residence is assessed separately. Compare your current ILR prospects with the new family timetable before switching, including the consequences for dependants.
After approval, check the route and endorsement actually granted. The post-decision guidance ↗ distinguishes ordinary partner permission from fiancé permission: the latter does not provide the ordinary right to work or study before a successful application following the marriage or civil partnership. Keep the decision and new eVisa, then update the employer's right-to-work evidence.
